EFSA Consults on Δ8-THC: Draft Points to Similar Toxicity as Δ9-THC

August 2025  - The European Food Safety Authority (EFSA) has opened a public consultation on its draft scientific opinion to derive a health-based guidance value for Δ8-THC in food. 

The draft notes that Δ8-THC is an isomer of Δ9-THC with similar mechanisms and effects. In some foods, Δ8-THC levels exceed Δ9-THC, indicating possible addition or formation during processing. EFSA recommends updating the Δ9-THC risk assessment, studying transfer of Δ8-THC into animal products, and investigating formation during processing and storage.

Since 2023, Regulation (EU) 2023/915 set EU maximum levels for Δ9-THC equivalents apply to hemp seed (and processed seed products) 3.0 mg/kg and hemp seed oil 7.5 mg/kg; defined as Δ9-THC + 0.877 × THCA.
