Food colourings and water soluble artificial dyes are widely used across the UK and EU food and drink industry to enhance appearance and ensure visual consistency. These additives are strictly regulated; food business operators are responsible for ensuring that any colours used are authorised for the intended application, do not exceed maximum permitted levels and are correctly labelled.

As well as testing authorised food colours, we provide targeted screening for prohibited or unauthorised dyes. Unauthorised azo dyes such as Sudan dyes, Rhodamine B and Orange II have no legitimate use in food; they pose health risks and remain strictly prohibited under EU and GB assimilated food law.

Regulatory context in the EU and GB*

European Union (EU)

  • Food colours are regulated under  Regulation (EC) No 1333/2008 on food additives

  • Commission Regulation (EU) No 231/2012 sets the specifications and purity criteria for authorised food additives, including colours

  • Only additives on the EU positive list may be used, and their use must follow conditions such as: permitted food categories, maximum levels, quantum satis (where applicable)

  • Labelling requirements apply, including declaration of specific colours and any required warnings

Great Britain (GB)

  • These EU regulations continue to apply in GB as assimilated (retained) law following EU Exit

  • Enforcement is delivered through national legislation and guidance

  • Unauthorised dyes, including certain azo dyes such as Sudan dyes and Rhodamine B, remain prohibited in both the EU and GB
