Arsenic occurs naturally in the environment and can enter food and feed through water, soil and raw materials. Inorganic arsenic is classified as a carcinogen and poses the highest toxicological concern, while certain organic arsenic compounds are also subject to monitoring.

In the European Union (EU), maximum levels for arsenic are set under Commission Regulation (EU) 2023/915. In Great Britain (GB), these requirements continue to apply as assimilated law following EU exit.

Legal context

  • Commission Regulation (EU) 2023/915 (Contaminants Regulation; applicable in EU and as assimilated law in GB)

  • Directive 2022/32/EC (undesirable substances in feed), establishes limits for arsenic in feed materials and compound feed in the EU and remains in force in GB as assimilated law for feed businesses and importers

  • Commission Recommendation 2022/C 206/01 (inorganic arsenic in feed) provides EU guidance on monitoring inorganic arsenic in feed and is considered relevant risk-based guidance in Great Britain
